Natural Stone Disclamer
Natural stone products, including but not limited to marble, travertine, and limestone, are formed by
nature. As a result, variations in color, veining, shading, texture, pores, pits, fissures, and other
geological characteristics are inherent and unavoidable. Samples are provided solely as a general
reference and may not represent the exact appearance of the delivered material. Quarry location and
extraction period may influence the final product.
Such natural variations are not considered defects and are an inherent characteristic of natural stone
materials. Due to the natural formation process, minor dimensional tolerances and aesthetic differences
may occur and shall not constitute grounds for rejection or claim. Milastone shall not be held liable for
differences between individual stones or variations from samples.
Certain natural stones may be porous. While generally durable, natural stone surfaces may be subject to
staining, scratching, or wear depending on use and environmental conditions. Milastone makes no
expressed or implied warranties regarding stain resistance, scratch resistance, or impermeability.
All materials must be unpacked and thoroughly inspected prior to installation. Any claims submitted after
installation, cutting, or alteration of the material will not be accepted. The final appearance of the stone is
influenced by design, workmanship, installation methods, joint detailing, sealers, and cleaning
procedures.
The determination of product suitability for the intended use, including slip resistance, maintenance
requirements, and compliance with applicable standards, remains the sole responsibility of the
customer. Milastone shall not be responsible for damages resulting from improper installation, misuse,
or misapplication.
After the goods are shipped, Milastone has no control over the application, installation, or use of its
products. Accordingly, all risk and liability associated with the use of natural stone products rest solely
with the customer, installer, or end user. In no event shall Milastone be liable for any indirect, incidental,
consequential, or special damages, including but not limited to loss of use, loss of profits, or labor costs.
Slip resistance may vary depending on surface finish, environmental conditions, footwear, and
maintenance practices. Milastone does not guarantee slip resistance and assumes no liability for
accidents, injuries, or damages related thereto.

INCOTERMS® 2020 – RISK TRANSFER CLAUSE
For deliveries made under Ex Works (EXW) or Free On Board (FOB) Incoterms® 2020, all risk of
loss, damage, or delay shall transfer from Milastone to the buyer at the point of delivery as defined
by the applicable Incoterms® rules.
Under EXW terms, risk transfers when the goods are made available at Milastone’s premises.
Under FOB terms, risk transfers when the goods are loaded on board the vessel at the designated
port of shipment.
